GROUPON GIFT CARD TERMS OF SALE – UNITED KINGDOM

1.       Using a Gift Card

1.1.     A Groupon gift card (“Gift Card”) is a card that entitles the holder of such Gift Card (“Gift Card Holder”) to redeem it towards the price of eligible products and services on Groupon’s Site (as defined in the Terms of Use) during the period of time stated on the Gift Card.

1.2.     When making a purchase on the Groupon Site, you must enter the Gift Card code. Any unused Gift Card balancing following redemption will be automatically placed in the Gift Card Holder’s Groupon account as Groupon credit; if the purchase price of the item the Gift Card Holder seeks to purchase is greater than the amount of the Gift Card, the Gift Card Holder must pay the difference with another method of payment.

1.3.     Groupon reserves the right to reject your attempted purchase of a Gift Card. Groupon further reserves the right to cancel your Gift Card at any time if it reasonably suspects that you have committed or that you may be committing any fraud against Groupon or an affiliated third party.

1.4.     You may only use the Gift Card on the Groupon Site. The Gift Card cannot be resold, transferred for value or redeemed for cash. Any Groupon credit you may have as a result of the Gift Card cannot be transferred to another Groupon account.

1.5.     You must use the Gift Card during the validity period. Failure to do so will result in the Gift Card’s expiry and you will not be entitled to any reimbursement or compensation. Please note that any Groupon credit you receive as a result of the Gift Card is valid for one year from the date of issuance of the credit.

Cancellation (and exceptions), Refunds and Problems

2.1.     You have a statutory right to cancel your purchase of the Gift Card within 14 calendar days after the day you receive the confirmation email (the “Gift Card Cancellation Period”). However, if you redeem your Gift Card during the Gift Card Cancellation Period, you expressly request Groupon to begin providing the services to you, and you acknowledge that you lose your right to cancel the purchase of the Gift Card.

2.2.     If you want to cancel your purchase of a Gift Card you can do so in any of the following ways:

2.2.1.  by filling out and submitting the cancellation form online;

2.2.2.  by calling the customer service team at 0203 510 0444;

2.2.3.  by contacting us at http://www.groupon.co.uk/contact; or

2.2.4.  by writing us at the address mentioned in section 1.2.

2.3.     If you cancel your purchase of the Gift Card in accordance with this section 2, Groupon will refund you for all payments made as part of your purchase within 14 calendar days from the day on which you informed Groupon about your cancellation.


3.       Groupon’s Standards of Services and Liability

3.1.     Groupon does not exclude any liability that cannot be excluded by law. Other than that, Groupon is not liable for any losses not caused by its breach or any other losses or damages you may suffer, including any indirect losses. Other than the liability which cannot be limited, Groupon’s total liability to you will in no circumstances exceed the amount of the purchase price of the Gift Card.

3.2.     The risk of loss and title to the Gift Card passes to the Gift Card Holder upon receive of the Gift Card via email. Groupon is not responsible if the Gift Card is lost, stolen, destroyed or used without your permission.

3.3.     The Groupon Terms of Use and Voucher Terms of Sale apply to your purchase of a Gift Card. If there is a dispute about this Gift Card, and you wish to bring a legal claim against us, you must do so within the United Kingdom (and English courts shall have the exclusive jurisdiction for your legal claim). If you live in England and Wales, the laws of England shall apply; if you live in Scotland, then Scottish law shall apply; if you live in Northern Ireland, then Northern Irish law shall apply. The previous sentence applies to all non-contractual relationships between you and us.
